EXHIBIT D - HD FLEET VIDEO DEVICES & SENSITIVE DATA ACKNOWLEDGMENT
As part of HD Fleet’s fleet management service, your company is using AI dash cameras that may capture video, audio, and driving data. This exhibit outlines the responsibilities, limitations, and data sensitivity policies associated with these devices.
Personal Data and Privacy Regulations
In accordance with the Personal Information Protection Act and other applicable privacy laws, the misuse or unauthorized distribution of recorded video, audio, or images—particularly those containing personal information—may result in legal liability for the user and/or the owner of the device. Users must exercise caution and discretion when accessing, storing, sharing, or using recorded content.
Camera Maintenance and SD Card Use
- Certain camera models include removable SD memory cards, which should be checked regularly for errors or signs of wear. These cards are consumable and may require periodic replacement.
- HD Fleet provides:
- Daily camera health reports and a live status board to help ensure all devices are operating as expected.
- Daily snapshot images (JPEGs) for each trip to verify that driver and road views are unobstructed.
- Customers are encouraged to set up camera obstruction alerts to proactively coach drivers on proper camera placement and view clearance. HD Fleet is not responsible for any malfunction, data loss, or damage resulting from:
- Use of counterfeit, modified, or unauthorized parts and accessories.
Failure to replace worn-out SD cards.
Environmental impacts or misuse of the device.
Accident Recording Disclaimer
- While our cameras are designed to capture incidents triggered by impact sensors, HD Fleet does not guarantee the recording of all events. Factors that may prevent incident recording include:
- Impact level below sensor threshold
- Incorrect or low sensitivity settings
- Device damage during the collision
- Non-collision impacts (e.g., potholes, speed bumps) triggering false positives HD Fleet is not liable for the loss of any video data due to hardware failure, user settings, or severe collisions that disable the device.
Cellular Data Usage Policy
- For devices using a cellular data plan or subscription:
- Device settings directly impact data usage. For example:
- Low G-sensor sensitivity may result in more frequent event triggers.
- High video resolution and frame rate settings create larger files.
- HD Fleet offers unlimited data, but usage is projected to remain under 1,000 MB per device per month.
- Accounts consistently exceeding this threshold may have media upload behavior modified (e.g., videos replaced with static images for non-critical events).
- This change does not impact locally stored data on the device.
